Terms of Service

1. Eligibility

You must be at least 16 years old and able to form a legally binding contract to use the App. By using the App, you represent that you meet these requirements.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information when registering and to keep it current. You may delete your account at any time from the App's About screen.

3. Access & Payment

Core features of the App require a one-time in-app purchase of $29.99 AUD, processed by Stripe. Payment grants you a non-transferable, non-exclusive license to use the App for personal, non-commercial purposes. Refunds, where applicable, are handled in accordance with applicable consumer law and the relevant store's refund policy.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful, harmful, or fraudulent purpose.
• Attempt to access another user's data or circumvent the App's access controls.
• Reverse engineer, decompile, or redistribute the App or its content.
• Upload content that infringes the rights of any third party.
• Use the App in a way that could damage or impair its availability.

5. Your Content

You retain ownership of the study notes, reflections, schedules, and other content you create in the App. You grant us a limited license to host, store, and display that content solely to provide the App to you. You are responsible for the content you create and for ensuring it complies with your institution's and employer's confidentiality obligations.

6. Not a Medical Service

PlaceMate is a study and wellbeing companion. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for professional clinical judgment, your institution's protocols, or your clinical educators' guidance. Always verify clinical information against authoritative sources before applying it in practice.

7. Intellectual Property

The App, its design, and its original content are the property of Beyond the Scrubs and are protected by Australian and international laws. PlaceMate and related marks are the subject of Australian trademark and copyright registrations (2642447, 2640576).

8. Disclaimer of Warranties

The App is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the App will be uninterrupted or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, Beyond the Scrubs shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the App. Where law implies guarantees that cannot be excluded, our liability is limited to resupplying the App or paying the cost of resupply.

10. Termination

We may suspend or terminate your access if you breach these Terms. You may stop using the App and delete your account at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will remain in effect.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, notify you through the App. Continued use after changes take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland, Australia.
